What’s the difference between express and implied consent? Express consent means that a person has agreed to receive a CEM clearly, either on paper or orally. The receiver must have a proactive action to point their express consent (quite simply, express consent must be obtained through an opt-in system, e.g. registering at the website). Understand that an electronic message that has a request for express consent is also considered to be a CEM under CASL and therefore is not a method by which express consent can be acquired. You may rely on implied consent for sending CEMs if it’s done under certain conditions, as set out in section 10(9) of CASL.
